§ 1 Scope
The following General Terms and Conditions apply to the business relationship between Gebr. Mann Verlag GmbH (hereinafter: the Seller) and the customer.
§ 2 Ordering
You are welcome to browse our range at your leisure. If you find something of interest, please order it by e-mail to info@gebrmann.de. Please state the title you would like (with ISBN if possible), the quantity and your delivery and billing address.
Sending your e-mail places your order and forwards it to us. By placing your order, you declare with binding effect that you wish to purchase the goods.
§ 3 Conclusion of the contract
When you place an order, you enter into a contract with: Gebr. Mann Verlag GmbH, Kyffhäuserstraße 11, 10781 Berlin, Germany, telephone +49 30 700 13 88-0, e-mail info@gebrmann.de, Amtsgericht Charlottenburg HRB 280299 B.
The contract for the purchase of a product is concluded when we confirm the acceptance of your order, and thus the conclusion of the contract, in an e-mail entitled “Order Confirmation” (Auftragsbestätigung). You will receive this message without undue delay, but no later than 3 days after your order has been received by us.
We store the text of the contract, including your order, and will send it to you on request together with our General Terms and Conditions.
The language available for concluding the contract is German.
§ 4 Reservation in case of non-availability
We reserve the right not to execute your order if we do not have the ordered title in stock, the title not in stock is out of print and the ordered goods are therefore not available. In this case, we will inform you of the non-availability without undue delay and refund any purchase price you have already paid without undue delay.
§ 5 Shipping costs
We deliver to Germany, Austria and Switzerland free of shipping charges. For deliveries to other countries, we will inform you of the shipping costs before the contract is concluded. For deliveries to Switzerland and to other countries outside the European Union, import duties (e.g. customs duties, import VAT) may be incurred, which are to be borne by the customer.
§ 6 Payment
Please pay within 14 days of receipt of the goods to the account stated in the invoice. You can pay by bank transfer.
The invoice is issued by Medien Service Runge GmbH (Runge Verlagsauslieferung), Bergstraße 2, 33803 Steinhagen, Germany, which acquires the Seller’s claim to the purchase price for this purpose. Payments made to Medien Service Runge GmbH discharge your payment obligation.
§ 7 Retention of title
The goods delivered remain the property of the Seller until the purchase price has been paid in full by the customer.
§ 8 Warranty
The statutory warranty (legal guarantee) applies. The minimum period is two years; national law may provide for a longer period. Voluntary guarantees do not affect your statutory rights.
§ 9 Dispute resolution
We do not participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Place of jurisdiction
If the customer is a merchant (Kaufmann) or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the court having jurisdiction for our registered office in Berlin.
§ 11 Governing law
The law of the Federal Republic of Germany applies. This does not affect mandatory provisions of the country in which the customer has his or her habitual residence.
